Let me say what I have to say and then post if you agree or disagree.
The preservation of video games (in ROM or PROM or EEPROM format) is an absolute must. If 50 years from now the world moves on, then what will the people of that time think of all those years invested in gamming if they don’t have anything that shows-face from our time? I’m not an activist in any form of politics but I am an activist in the preservation of all video games.
For instances:
Nintendo released and new Super Mario game for the DS. It’s a revisit of the first game with much more licks and tricks up its sleeve. Although this game is sure to be a smash hit, how long will it survive? It may do so rather well but when the world moves on, who will remember it?
I often think of games like ‘Gyruss’ and ‘Star Castle’. These were games that struck our world for a brief period of time and almost completely faded away. Without the power of arcade emulation on our PCs, these games would have been lost forever like the Ark of the Covenant… Think about it.
Let us say that we live in 29 A.D. and Chess was introduced to all of us for the first time. Now let’s say that a few generations forgot the games that their fathers played and went on in life without the satisfaction of a checkmate for the first time. To experience a game isn’t a game it self, but rather a connection to culture and life in general. Its what makes us people. It’s what gives us character.
I can fully understand Nintendo’s approach on keeping their games in a vault and not letting anyone legally own the images without owning the game cart or ROM chip. They are bringing the games back in the Nintendo Wii, but for how long? With new laws and crack-downs on sites that hosts these images are making it impossible for historians like me to keep a world library of gaming history. All my sites were attacked and now closed by the former SPA and other groups that send the “Cease and Desist” e-mails.
So I’m calling for legal advice. If anyone knows of any loop-holes in the laws concerning emulated ROMs, please contact me via PM here at the sector.
Thanks for reading…

I don't think there is any loop-holes concerning ROMs, sorry the only thing you could do is get the ROMs anyway, but that's illegal. |

Qix,
I doubt if you collect these ROMS and keep them for your own that Nintendo or whoever will break down your door and seize your computer. I think the problem they have is with someone distributing them, since it's still copyrighted material.

I think ROMs are only legal if you also own the original.
Like, if you already have an Tron arcade game, you can have the ROM for it for MAME.

Yeah they fall under the intelletual property rulwe I think for software. Since it is not open source and all that. I think like what you and your brother had mentioned in order to have the emulated version you need the actual rom from the arcade game as well either in the EPROMS or on the PCB's...

To me, it sounded like Qix was lamenting the fact that he cannot find sites that host these ROM images, because they all get shut down. Even if the site admins own every ROM they host, I think they'd still get shut down because you're still not legally entitled to distribute the ROMS.

Seriously? You have to be kidding. They actually came to your house and made you delete it? They have nothing BETTER to do?
Just curious... do you live in the United States?

Uhhhh... since when does www.download.com offer ROM images??? It's a part of C-net.
And you only got fined 50 bucks and only had to delete the file, nothing got confiscated or anything?

I seriously doubt that. There is that whole "freedom of speech" guaranteed by our Constitution thing.
Some sites, though, enforce a strict edict when it comes to that kind of stuff. A PSP site I visit will ban you for even mentioning ISO's.
