This is a must read. A new copyright law has just been passed which will effect photographers and illustrators whos work isn't marked. Orphan works are basically works whose copyright owners cannot be located. If it's not marked and you can't find the owner after a "good faith, reasonably diligent search," then it's fair game for a free liscense. This being the internet... that's very problematic. While it's a U.S. copyright law, overseas work could easily fall victim to this law if you think about it. That's just half of the problems. Read the link below.

What's to keep some unscrupulous person from stripping the info from the images and reusing them without trying to get the rights?

...Granted, doesn't this conflict with the current copyright law that when an artwork is created, it's automatically copyrighted?
How would it work with that law?

Yeah. It conflicts with that, but if you can't find the orignal creator of an orphan work, then you can get a license to use that image as it says. But as Dave pointed out and I fear, whats to keep someone from removing the mark. Instant dangerous loophole. This is a problem that is on the net right now with many sites posting various media. They take something, put their mark on it and distriute it, even if it wasn't created by them. I suppose you could always incorporate a trademark into your artwork much like Herchfield's (sp?) "Nina" you can find in ALL his drawings. Then you can always prove it's yours. And print and keep originals of all your work too, of course.

And there's issues with art thieves as it is...
Deviant Art doesn't seem to deal with art thieves properly. (In their case, they ban the people who report the real art thieves. What kind of behavior is this?)
