CompUSA commercial

I've now been asked a couple of times if I did a commercial for CompUSA:

They show a guy sitting at a computer with someone who (according to my sister) looks just like me, down to body shape and mustache, standing behind him in a duplicate of my costume. The voiceover says, "We have computer geeks who can fix your computer problems." The geek then leans over and quickly fixes the problem.

No, I had nothing to do with it. I wish I did.

Any of you folks out there happen to have the commercial on videotape or TiVo? If so, I'll deeply appreciate a copy. So far, I've only heard of it being run on TV in Dallas and Houston, but it's possible it ran elsewhere. I've now gotten reports that it's run on Fox Sports Southwest and ESPN.

If you've seen it, or got it on video, please let me know ASAP. Thanks.

Can they do that? Use your likeness and the suit you designed?

Let us know once you have found out if they did. I can only assume that they are not allowed to do so under US Law. I don't know if this applies to the same thing under the Canadian law as well.

Where are they playing this commercial? Do you know if there is a specific network it's on?

I have been watching out for it and trying to catch it. No luck so far.

Me either, but I've been told that a DVD is headed my way with 5 different commercials on it.

You really ought to sue.

Isn't the Superbowl on this weekend? I think that might be a likely place to watch for it.

I don't know if CompUSA would have spent Super Bowl-class dollars on this commercial...though I wouldn't mind much if they did.

I watched the conference championships last weekend, and they did not run it then.

They can't under Canadian laws. It falls under copyright laws. The only way they are actually allowed to use that is if they were either using it as a parody, for education or as a critique. Since they were doing neither.... it definately ILLEGAL by Canadian law. Matter of fact, illegal all across the board. Good thing we like to talk about law in our media courses.

Of course, I'd avoid lawyers like the plague if I were you. As bad as CompUSA was, lawyers are even a little worse cause they use these little legal loop-holes to screw you over. Careful there, Jay!

Firstoff, I haven't seen the commercial in question if indeed it does exist. I'm sure we'll have an answer on that within the next week or so.

Secondly, if the commercial exists, it could always be an "unofficial" one, similar to the fake Volkswagen ad that recently made headlines.

If the commercial is real and is official, you still may unfortunately have a hard time making any sort of case. This goes double if they got permission from Disney (or whoever holds the copyright) to use Tron. They could easily counter any argument with "you don't own Tron, nor do you own his suit." I'm not a lawyer, mind you. I'm a 25 year old slacker and occasional amateur filmmaker. But I've seen enough news to see how corporations respond to similar claims.

I wish you the best of luck if the ad turns out to be genuine. I think most of us (and especially the members of Tron-Sector) will realize who's trying to cash in on whose image, and who's in the right.

If it isn't real, and somebody's pulling one over on you, I'd suggest having a long talk with them instead.

Correct me if I'm wrong here, since I've never actually have seen any "Tron Guy" clips (I don't think I have the channel that it's on. I have so few channels over here along with being stuck on dial-up.) is it supposed to be some sorta parody thing? If that's the case, Jay would be protected by copyright law because of this. In that case, CompUSA is in for it.

Jay sent me a copy of these, and after viewing them I gotta say I think it might be a stretch to call it a direct copy of Jay. Certainly a lot of similarity, but there are some differences too that make it unique unto itself.

It's certainly a legal quagmire. I wouldn't put any bets on a win or a lose if it were to go legal.

Recomendation: Don't. There's definately nothing gained by that. All it would be is a BIG waste of time. (Of course..... empoying the use of recognizers is an entirly different story *Evil grin* )
